- These are both infractions. Being under 21 and driving with a BA between. 01 and. 04 is a violation of Veh C 23136 it is NOT DUI. It is not a point, but it results in a one year license suspension and the scheduled fine is around $320. Speeding is one point, and also carries a fine of about $320. If you are eligible for traffic school, you can keep that off your record. I don't know if you will be permitted to go to traffic school on the 23136 offense or, if you did, whether it would save your license from DMV action. Obviously, the most serious consequence you are facing is the license suspension. If you can afford it, it certainly could not hurt to at least consult an attorney concerning your options for dealing with that offense
- No experience with this, but I can tell you that you will need a lawyer if you want to fight this. And whatever the outcome, you will be paying a lot of money. If you want the charges dropped, you will have to pay through the nose for a really good lawyer. You could pay less for a mediocre lawyer, and hope to have the charges reduced to reckless driving or something, which will still have a fine and higher insurance premiums. Or, you could not get a lawyer, pay a hefty fine, lose your license for a while, and pay very high insurance premiums
